Terms of Service

These Terms of Service govern your use of Lately, a peer-to-peer rental marketplace. By creating an account or using the platform, you agree to these terms. Please read them carefully — they explain what we expect from you, what you can expect from us, and how we handle things when something goes wrong.

1. Acceptance of Terms
By accessing or using Lately, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the platform.
We may update these Terms from time to time. We will notify you of material changes by email and by posting a notice on the platform. Continued use after the effective date of any update constitutes acceptance of the revised Terms.
2. Eligibility
- You must be at least 18 years old to use Lately.
- You must be capable of forming a legally binding contract under applicable law.
- By using Lately, you represent and warrant that you meet these requirements.
- We reserve the right to suspend or terminate accounts that we reasonably believe are operated by minors or in violation of eligibility requirements.
3. Accounts and Responsibilities
When you create an account, you agree to:
- Provide accurate, complete, and current information.
- Keep your login credentials secure and not share them with others.
- Notify us immediately at support@lately.cc if you suspect unauthorised access to your account.
- Be responsible for all activity that occurs under your account.
Lately is not liable for any loss or damage arising from your failure to keep your account credentials secure.
4. Supplier Obligations
If you list items for rent on Lately, you agree to:
- Accuracy — Listings must accurately describe the item, its condition, any accessories included, and any known limitations.
- Availability — You must keep your availability up to date. Accepting bookings you cannot fulfil damages trust and may result in account suspension.
- Condition — Items must be clean, functional, and in the condition described at the time of handover.
- Timely response — You must respond to booking requests within the response window you have set. Repeated non-responses may result in account restrictions.
- Prohibited items — You may not list weapons, illegal items, hazardous materials, or any item whose rental is prohibited by applicable law.
- Verification — Suppliers must complete identity verification before their listings become bookable. We may request additional documents at any time.
5. Renter Obligations
If you rent items through Lately, you agree to:
- Care — Treat rented items with reasonable care. You are responsible for any damage, loss, or theft that occurs during your rental period.
- Timely return — Return items by the agreed end date and time. Late returns may result in additional charges at the supplier's daily rate and may trigger a dispute.
- Permitted use — Use items only for their intended purpose and in compliance with applicable law.
- Honest booking — Do not create bookings with no intention to rent. Repeated no-shows may result in account suspension.
6. Payments and Deposits
- Payment — Lately facilitates bookings but does not process payments directly. Renters submit payment references (e.g. bank transfer confirmations) through the platform, and suppliers confirm receipt.
- Deposits — Suppliers may require a security deposit. Deposits are held by the supplier and must be returned to the renter within a reasonable time after the item is returned in agreed condition.
- Disputes over payment — If a payment or deposit dispute arises, Lately may mediate but is not liable for any outstanding amounts between users.
- Supplier subscriptions — Suppliers pay a platform subscription fee of $20 per month to list items, with no commission taken on rental income. New suppliers receive a free trial of 3 months, beginning when Lately approves their identity verification; the subscription fee applies only after the trial ends. We may change the trial length or the subscription fee for suppliers who sign up in future, but a trial already granted to you will be honoured for its full term. Failure to maintain an active subscription after the trial will result in listings being hidden from search and from your shop page. Listings and booking history are not deleted, and are restored when the subscription is renewed.
7. Prohibited Activities
You may not use Lately to:
- List or rent items that are illegal, dangerous, or stolen.
- Engage in fraud, misrepresentation, or deceptive conduct.
- Harass, threaten, or abuse other users, including in messages.
- Circumvent the platform by transacting outside of Lately to avoid fees, including by using messages to move a booking off the platform, or by deliberately disguising contact details to defeat the protections described in Section 9.
- Send unsolicited advertising, promotional material, or repeated unwanted messages to another user.
- Scrape, copy, or reproduce platform content without permission.
- Attempt to gain unauthorised access to the platform or other users' accounts.
Violating these prohibitions may result in immediate account termination and, where applicable, referral to law enforcement.
8. Disputes Between Users
Lately provides a dispute resolution process to help users resolve disagreements about bookings:
- Either party may raise a dispute through the platform within the dispute window after a booking ends.
- Both parties will be asked to provide evidence (photos, messages, receipts).
- Lately administrators will review the evidence and make a recommendation. Our recommendation is advisory — we are not a court and cannot enforce outcomes.
- For significant financial disputes, we encourage users to seek independent legal advice.
Lately is not liable for losses arising from disputes between users.
9. Messaging
Lately provides messaging inside a booking so renters and suppliers can arrange the practical details. By using it you accept the following:
- It belongs to a booking. Messaging is available only between the two parties to a booking, and only from the moment a request is made. There is no general messaging between users.
- Contact details are hidden before a booking is confirmed. Until the supplier confirms, we automatically hide phone numbers and email addresses that appear in messages and booking notes. This supports the platform’s booking flow and the protections in Section 7. It is an automated pattern check, not a guarantee — you remain responsible for what you choose to share.
- Lately administrators can read messages. For support, fraud prevention, and dispute resolution, our administrators can read the full text of any conversation, including details hidden from the other party. Messages are not private from Lately. Where an administrator takes part in a conversation, they are always identified as “Lately Support”.
- Messages are the record. Conversations are retained with the booking and are used as evidence in a dispute (see Section 8). They remain readable after a booking ends, though no new messages can be sent once it is closed.
- They outlive your account. If you close your account, your messages remain attached to the booking so the other party keeps their record of what was agreed. They are no longer linked to you and you are shown as “Deleted user”. This is explained in the Privacy Policy.
- We may act on what we find. Messages that breach Section 7 may lead to warnings, suspension, or termination under Section 12.
10. Platform Liability
- Lately is a marketplace platform. We do not own, inspect, or guarantee any item listed by suppliers.
- We are not party to rental agreements between users. The contract is between the renter and the supplier.
- To the fullest extent permitted by applicable law, Lately's liability for any claim arising from use of the platform is limited to the subscription fees paid by you in the 3 months preceding the claim.
- We are not liable for indirect, incidental, or consequential losses including lost profits, data loss, or personal injury arising from use of items rented through the platform.
11. Identity Verification and Data
To build trust and comply with platform policies:
- Suppliers may be required to submit identity documents (government-issued ID) and business registration documents. These are handled securely and are not shared publicly.
- Mobile number verification is required for all users to complete bookings.
- How we collect, store, and use your data is described in our Privacy Policy, which forms part of these Terms.
12. Account Suspension and Termination
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your supplier subscription lapses.
- You may close your account at any time by contacting us at support@lately.cc.
- On termination, active bookings will be handled on a case-by-case basis. Booking records are retained as described in our Privacy Policy.
13. Governing Law
These Terms are governed by applicable law in the jurisdiction where Lately operates. Any disputes arising from these Terms that cannot be resolved informally will be subject to the exclusive jurisdiction of the relevant courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
